1. Who we are

2. What we sell, and how it is meant to be used

We sell development boards and electronic hardware intended for prototyping, evaluation, education and hobbyist use.

Our products are supplied as development hardware. They are not certified, qualified or tested for use in safety-critical, life-supporting, medical, aerospace, automotive, nuclear or industrial control applications, or in any application where failure could cause injury, death or damage to property. You must not use them in such applications.

You are responsible for assessing suitability for your application, for correct wiring and power supply, for electrostatic precautions, and for any certification or regulatory approval your finished product requires.

3. Orders and pricing

Your order is an offer to buy. A contract forms when we confirm dispatch. We may decline or cancel an order and refund you in full, for example where an item is out of stock or a price is clearly wrong.

Prices are in US dollars unless shown otherwise. Shipping, duties and taxes are described in our Shipping Policy.

4. Warranty

We warrant that products are free from defects in materials and workmanship for 30 days from delivery. Our sole obligation under this warranty is, at our option, replacement or refund. See our Return and Refund Policy.

The warranty does not cover damage from incorrect wiring, reverse polarity, over-voltage, electrostatic discharge, soldering, modification, or use outside published specifications.

Beyond this warranty and your statutory rights, products are supplied as is, and we disclaim implied warranties of merchantability and fitness for a particular purpose to the fullest extent the law allows.

5. Limitation of liability

To the fullest extent permitted by law:

• Our total liability arising out of or in connection with any order is limited to the amount you paid for the products giving rise to the claim.
• We are not liable for indirect, incidental, special or consequential loss, including loss of profit, loss of data, loss of time, cost of substitute goods, or damage to equipment, circuits or property connected to or used with our products.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

If you are a consumer, your statutory rights are not affected. Consumers in the European Union and the United Kingdom keep the mandatory protections of their country of residence, including the right of withdrawal and the legal guarantee of conformity, and nothing in these terms overrides them.

6. Intellectual property

Designs, documentation, firmware, images and text remain the property of Millibyte LLC or its licensors, except where an open-source licence is expressly granted. Where hardware designs or firmware are published under an open-source licence, that licence governs your use of them.

7. Acceptable use

You may not resell our products as certified components, misrepresent their intended use, or remove or alter identifying marks.

8. Export control

You are responsible for complying with the export and import laws that apply to you. We do not ship to embargoed destinations.

9. Changes

We may update these terms. The version in force is the one published when you place your order.

10. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, USA, and the courts of Massachusetts have jurisdiction. If you are a consumer resident in the European Union or the United Kingdom, this does not deprive you of the protection of mandatory consumer law in your country of residence, or of your right to bring proceedings there.
